Can a labor union effectively control where you can live and work?
Q. Can a union legally make rules that restrict the relationship of where you live and work? If you wanted to live, for example, in one area or state, but work in another periodically, but the union restricts that sort of migration, is that legal? Would that union "law" conflict with federal or state laws? Assume that we are not dealing with right-to-work states. For example, I live in Nevada and want to work in New York for a few weeks. Thoughts anyone on the labor law for this?

A. They can't. If you want to work in another State, they may require you to check in with the Local out there but they can't tell you where you can work or not. NY is a big Union place so I'd check with the local out there before signing on anywhere...or just get paid under the table and no one will be the wiser.

What is the difference between civil union and marriage when BOTH are federally recognized?
Q. I get told that marriage is a religious sacrament between a man and a woman and that civil union is just the basic rights of married people without the religious association. If this is true then why are they both federally recognized? And how come a straight couple can get married by obtaining a marriage license and not have to go through a church ceremony at all? Information Police : Thanks for clearing that up. I meant recognized to some degree of government.

A. Civil unions are NOT federally recognized. I think you are confusing civil unions with civil marriages, which are marriages that are not conducted in a church. In the United States, marriage is a civil contract. It may be blessed by a religious ceremony but it does not have to be. If you have a church wedding but do not have a civil marriage license you are not married in the eyes of the law. Ironically, gay couples can have church ceremonies to bless their unions but in most places they cannot get a civil license. That seems totally backwards, doesn't it!

How does being in a union and getting laid off work?
Q. My husband has been working at his job for about three months and he was just laid off, he was paying his union dues and paying for his book also. What does being in the union do for him? Will they be able to get him another job? Can he still pay his dues and still have a pension and benefits? How does this work? Where do we go from here? I don't really know what the union is about and what purpose it serves so can someone please advise or point me in the right direction.
